Terms of Service for Brave

Thank you for choosing Brave! These Terms of Service (“Terms”) govern your use of our website, products, and services. By accessing or using the Brave website (the “Site”) and/or purchasing our products, including the BraveBand, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using the Site or purchasing our products.

1. Introduction
Brave (“we,” “us,” or “our”) is committed to promoting safety, connection, and empowerment. We provide stylish, tech-enabled bracelets designed to help prevent sexual assault and keep people safe in social settings. By using our products, you are helping us work toward a future where people can go out, have fun, and feel secure.

2. Products and Services
Our products include the BraveBand, a wearable device that sends “buzzes” to connected devices to alert friends and help locate each other in a crowd via the Compass feature and the BraveBand application that allows accurate tracking and two way communication. The BraveBand is fully customizable and designed to provide safety in a stylish form.

While we aim to provide high-quality products, please note that the BraveBand is still in development, and features such as the Compass function are only available on iPhone 11 or newer models. As such, we do not guarantee all features will work on every device or under every circumstance.

3. Orders and Payment
By placing an order for a BraveBand or any other product, you agree to pay the listed price plus any applicable taxes and shipping fees. Payment must be made at the time of purchase, and you will be billed accordingly. All orders are subject to availability, and Brave reserves the right to limit or cancel orders at our discretion.

4. Pre-sale and Delivery
If you place a pre-sale order, the expected delivery date of the BraveBand is Fall 2025. As a thank you for your support, you will receive a complimentary matching bonus bracelet within 5-6 weeks of your order. Please note that delivery dates are estimates and may be subject to change.

5. User Responsibilities
You are responsible for ensuring that the information you provide during the ordering process is accurate and complete. You are also responsible for keeping your BraveBand and any connected devices, including mobile phones, safe and secure.

By using our products, you agree not to engage in any behavior that could damage, disable, or interfere with the functioning of our products, website, or services.

6. Account and Security
To use certain features of the BraveBand and related mobile app, you may be required to create an account. You are responsible for maintaining the confidentiality of your account and any associated passwords. You agree to notify Brave immediately if you suspect any unauthorized use of your account.

7. Privacy and Data Collection
Brave is committed to safeguarding your privacy. We may collect and store certain personal data, including your order history and app usage data, as described in our Privacy Policy. By using our services, you agree to the collection and use of your personal data in accordance with our Privacy Policy.

8. Proprietary Rights

As between you and Brave, Brave is the owner and/or authorized user of any registered or unregistered trademark, trade name, and/or service mark appearing on the Site, and is the copyright owner or licensee of the materials and content on the Site, unless otherwise indicated. The Brave logos, designs, titles, phrases, product names, and the copyrights, trademarks, service marks, trade dress, and/or other intellectual property in such materials (collectively, the "Intellectual Property") are owned by Brave and may be registered in the United States and internationally.You agree not to display or use the Intellectual Property in any manner without Brave’s prior written permission. Nothing on the Site should be construed to grant any license or right to use any of the Intellectual Property without the prior written consent of Brave. Except as otherwise provided herein, use of the Site does not grant you a license to any materials and content or features you may access on the Site, and you may not modify, rent, lease, loan, sell, distribute, or create derivative works of such materials and content, features, or materials, in whole or in part. Any commercial use of the Site is strictly prohibited, except as allowed herein or otherwise approved by us. You may not download or save a copy of any of the materials and content or screens for any purpose except as otherwise provided by Brave.If you make use of the Site, other than as provided herein, in doing so you may violate copyright and other laws of the United States and/or other countries, as well as applicable state laws, and you may be subject to liability for such unauthorized use. The information on the Site, including, without limitation, all site design, text, graphics, interfaces, and the selection and arrangement of such, is protected by law, including, but not limited to, copyright law.

9. Limitation of Liability
To the fullest extent permitted by law, Brave shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our products or services, including but not limited to injuries, emotional distress, or damages resulting from a failure of the BraveBand to perform as expected. You agree to use our products at your own risk. Brave does not guarantee the elimination of sexual assault and cannot guarantee the prevention of assaults or abuse. Please contact emergency authorities and or the National Sexual Assault Hotline or speak with a professional in order to seek help and services if you or someone you know are sexually assaulted.

10. Third-Party Services
Our website may contain links to third-party sites or services that are not owned or controlled by Brave. We are not responsible for the content, privacy practices, or terms of service of any third-party site or service.

11. Modifications to Terms
Brave reserves the right to modify these Terms of Service at any time. Any changes will be posted on this page, and the effective date will be updated accordingly. By continuing to use our website or services after such changes, you agree to the updated Terms.

12. Termination
Brave reserves the right to suspend or terminate your access to our products and services at our discretion, without notice, for violations of these Terms or other actions that we determine are harmful to our community.

These Terms will be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms will be resolved exclusively in the courts located in California.
